Introduction
These Website Terms of Service written on this webpage govern your use of our website Rosa Underwear.
Article 1 – Definitions
Reflection period: the period within which the consumer can exercise their right of withdrawal.
Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.
Distance agreement: an agreement in which, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.
Distance communication technology: means that can be used to conclude an agreement, without the consumer and entrepreneur being in the same room at the same time.
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer. Before a distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated how they can be accessed electronically or provided free of charge upon request.
Article 4 – The offer
The offer is non-binding. It contains a complete and accurate description of the products and/or services offered. Images are indicative and may differ slightly from actual products. Obvious errors in the offer do not bind the entrepreneur. The offer clearly states the price, shipping costs, payment methods, delivery process, right of withdrawal (if applicable), and duration of validity.
Article 5 – The agreement
The agreement is concluded once the consumer accepts the offer and meets the stated conditions. For electronic orders, the entrepreneur will confirm receipt electronically. The entrepreneur reserves the right to verify whether the consumer can meet their payment obligations and may refuse orders with valid reasons.
Article 6 – Right of withdrawal
Consumers may withdraw from a purchase within 14 days of receiving their order without giving reasons. Products must be returned in their original condition and packaging. The consumer must notify the entrepreneur in writing within this period and return the products within 14 days thereafter.
Article 7 – Costs in case of withdrawal
Return costs are the responsibility of the consumer. Refunds will be made within 14 days after receipt of the returned goods or proof of shipment.
Article 8 – Exclusion of withdrawal
The right of withdrawal may be excluded for products made to the consumer’s specifications, hygiene-sensitive items once unsealed, and other legally exempt categories.
Article 9 – Prices
Prices stated are exclusive of any applicable customs duties, import VAT, or clearance costs, which remain the responsibility of the consumer. Prices are subject to typographical errors, which do not oblige the entrepreneur to deliver at the incorrect price.
Article 10 – Conformity and warranty
Products must comply with the agreement, specifications, and reasonable expectations of usability. Any defects must be reported within 14 days of delivery. Warranty does not cover misuse, alterations, or damage caused by the consumer.
Article 11 – Delivery and execution
Orders will be fulfilled with due care. Delivery will occur within 30 days unless agreed otherwise. If delivery is delayed, the consumer will be informed, and may cancel the contract with a full refund. The risk of damage or loss passes to the consumer upon delivery.
Article 12 – Duration contracts and termination
Contracts of indefinite duration may be terminated by the consumer with a maximum one-month notice period. Fixed-term contracts may be terminated at the end of the agreed period. Unlawful tacit renewals are not permitted.
Article 13 – Payment
Unless otherwise agreed, payment must be made within 7 working days of the reflection period commencing. Inaccuracies in payment details must be reported immediately. In cases of non-payment, reasonable collection costs may be charged.
Article 14 – Complaints procedure
Complaints must be submitted within 7 days of discovering defects. They will be answered within 14 days. If longer processing time is needed, the consumer will be informed of the expected resolution time. If no resolution is possible, disputes will be handled in accordance with Dutch law.
Article 15 – Disputes
All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
Article 16 – CESOP
Due to EU regulations, payment data may be registered in the Central Electronic System of Payment Information (CESOP) by payment service providers.
Article 17 – SMS messaging
By opting in to SMS marketing from Rosa Underwear, the consumer agrees to receive recurring promotional and personalized messages. Message frequency may vary. Standard message and data rates may apply. Consent is not a condition for purchase. Consumers can opt out at any time by replying STOP. Transactional messages (such as order or shipping confirmations) may still be sent even if the consumer does not opt in to marketing.
